fr "L'étude de l'expression du département dans les Constitutions françaises, de 1791 à nos jours, conduit à souligner la parenté, voire la conaturalité, qui caractérise depuis l'origine l'opération de rédaction d'un texte écrit qui détermine la forme de l'Etat, la dévolution et l'exercice du pouvoir, à savoir une Constitution, et la division du territoire national en unités nouvelles, les départements, afin de garantir l'indivisibilité du Grand Tout national" et de permettre la représentation de la souveraineté de la Nation. Le caractère consubstantiel de la fondation du constitutionnalisme moderne et de la création du département traduit, de manière originale, l'axiome séculaire qui fait dépendre l'organisation politique de la domination et de l'administration du territoire. Cette problématique se confirme par l'examen des textes des Lois fondamentales successives dont s'est dotées la France, afin d'en extraire les dispositions intéressant le département et d'en dégager, si elles existent, la ou les conceptions que les Constituants ont pu, en le régissant, se faire de celui-ci, de sa nature, de son organisation, de son rôle ou de sa fonction. Instrument constitutionnalisé de l'unité d'action du pouvoir politique central, de 1791 aux années 1940, le département se voit formellement reconnaître la qualité de collectivité territoriale de la République en 1946 et en 1958. De sorte que l'expression qui le caractérise désormais au plan constitutionnel - Constitution formelle et Constitution administrative du pays - sanctionne la permanence qui s'y attache, moteur de sa survie et de sa croissance, et la sociologie dont il est l'objet. Outre les décisions du Conseil constitutionnel justifiant l'apparition d'un droit constitutionnel local propre au département, les principes législatifs dégagés depuis les années 1980 autorisent le département à prendre son visage moderne. L'approche à travers l'histoire constitutionnelle permet d'enregistrer des modifications dans les rapports de droit des pouvoirs publics qui, surtout en droit constitutionnel, sont des modifications de rapports de pouvoir. A partir de ce droit, il est loisible de vérifier que le département, par sa structure territoriale, participe étroitement au phénomène de pouvoir. "
en "The study of the department expression in the French constitutions, from 1791 to nowadays, leads to stress the relationship, or even the co-naturality that has been characterizing, from the very beginning, the process of the working of a written text that determines the form of the State, the devolution and the exercice of power, i.e. a Constitution, and the division of the national territory in new units, the department, so as to guarantee the indivisibility of the Big National Whole" and to allow the representation of the Nation's sovereignty. The consubstancial character of the fundation of modern constitutionalism and the creation of the department conveys, in an original way, the age-gold axiom that makes political organization depend from the domination and administration of the territory. This issue is confirmed by the examination of the successive fundamental Laws France has been endowed with, so as to take out the arrangements involving the department and draw from that - if they exist - the conception or different conceptions the members of the Constituent Assembly could have got, by governing it, about its nature, its organization, its role or function. The department, constitutionalized tool of the unity of action of the central political power from 1791 to the years 1940, was positively recognized the authority of a territorial community of the Republic in 1946 and 1958. So much so that the expression that will henceforth characterizes it on the constitutional level - definite and administrative Constitutions of the country - sanctions its related permanency, the mainspring of its survival and growth, and the sociology it is subject to. Besides the decisions of the constitutional council justifying the arrival of a local constitutional law suitable for the department, the legislative principles brought out since the years 1980 allow the department to assume its modern appearance. The approach through constitutional history allows to note some changes in the rights relations of the authorities which, especially in the domain of constitutional law, are changes in the power relations. From that, it is possible to check that the department, on account of its territorial structure, closely participes in the power phenomenon. "
