fr Les œuvres des arts appliqués peuvent bénéficier, si elles en respectent les conditions, de la double protection du droit d’auteur et du droit des dessins et modèles. La notion de cumul de protection est ambivalente et a évolué. Si le droit des dessins et modèles a, pendant longtemps, subi l’influence du droit d’auteur, au point d’y sembler soumis, il paraît désormais avoir pris son autonomie, et être régi par des règles qui s’éloignent de plus en plus du droit d’auteur. L’étude de l’action en contrefaçon d’œuvres des arts appliqués sera le prétexte de vérifier la teneur de ce cumul de protection. Peut-il se réaliser systématiquement, à travers une action fondée sur les deux terrains ? Ou ne joue‐t‐il que dans certaines hypothèses, réduisant d’autant la conception cumulative française ? Les différences de nature qui existent entre les deux droits auront une influence sur leur mise en œuvre judiciaire. Ces différences verront le droit des dessins et modèles s’aligner nettement sur les solutions contentieuses du droit de la propriété industrielle. L’existence d’un droit hybride de propriété intellectuelle – le dessin ou modèle communautaire non-enregistré – pose la question de la distinction entre propriété littéraire et artistique et propriété, industrielle, souvent fondée sur l’existence d’un titre.Enfin, l’étude de l’action en contrefaçon d’œuvre des arts appliqués, en confrontant les solutions contentieuses du droit d’auteur et du droit des dessins et modèles, permettra de s’interroger sur l’émergence d’un droit processuel de la propriété intellectuelle, qui serait un véritable droit commun de l’action en contrefaçon de droits de propriété intellectuelle.
en The works of applied arts can, if they meet the conditions, be protected both under Copyright and Design law. The notion of simultaneous protection is ambivalent and has progressed. Even though the design protection has, for a long time, been influenced by Copyright, to the extent of being dominated by it, it seems that this right has now reached its autonomy, and is governed by its own rules which are increasingly different from Copyright. The analysis of the infringement actions of works of applied arts will be a reason to verify the actual extent of the simultaneous protection. Can the simultaneous protection be systematically achieved in case of actions based on both grounds? Or does it apply only in specific cases, therefore reducing the French cumulative conception? The difference of the nature of these two protections will have an influence on their judicial application. These differences will lead Design Law to align its rules with the case law governing Industrial Property law. The existence of a hybrid intellectual property right – the unregistered community design – raises the question of the distinction between literary and artistic property and industrial property, often based on the existence of a registration title.Finally, the analysis of the infringement procedure concerning works of applied art, through the study of both the Copyright and Design case law, will give the opportunity to consider the emergence of an intellectual property procedural law, which would truly be a statutory law governing infringement proceedings for all intellectual property rights.
